Starbucks Hong Kong Mobile Application Terms of Use

DOWNLOADING, INSTALLING, ACCESSING OR OTHERWISE USING THIS STARBUCKS HONG KONG MOBILE APPLICATION (THIS “APPLICATION") CONSTITUTES ACCEPTANCE OF THESE TERMS OF USE (“TERMS"), WHICH SUCH TERMS MAY BE REVISED BY COFFEE CONCEPTS (HONG KONG) LIMITED, AUTHORIZED LICENSEE OF STARBUCKS CORPORATION IN HONG KONG ("STARBUCKS", "WE", "US", OR "OUR") FROM TIME TO TIME UPON NOTICE TO YOU, AND IS A BINDING AGREEMENT BETWEEN THE USER ("USER", "YOU", "YOUR") AND STARBUCKS GOVERNING THE USE OF THIS APPLICATION. IF THE USER DOES NOT AGREE TO THESE TERMS, THE USER SHOULD NOT USE AND SHOULD UNINSTALL THIS APPLICATION IMMEDIATELY. THIS AGREEMENT CONTAINS DISCLAIMERS AND OTHER PROVISIONS THAT LIMIT OUR LIABILITY TO THE USER.

Eligibility

The Application may only be used by individuals aged eighteen (18) years or older. If the User is thirteen (13) years or older but under the age of eighteen (18) years, the User should review these Terms with the User’s parent or guardian to make sure the User and the User’s parent or guardian understand and agree to them. Should the User’s parent or guardian not agree to these Terms, the User must immediately uninstall the Application and discontinue its use.

In order to use certain functions of our Application, you will need to register for an account unless otherwise specified. You agree to (a) create only one account; (b) provide accurate, truthful, current and complete information when creating your account; (c) maintain and promptly update your account information; (d) to follow the guidance provided by us from time to time (including, but not limited to, through the Starbucks website and/or the Application) in designating a password (the "Password") when creating your account (you may change the Password at any time, but any change shall be effective only if accepted by us); (e) maintain the security of your account by not sharing your Password with others and restricting access to your account and your Device (as defined below) on which the Application is installed; (e) promptly notify Starbucks if you discover or otherwise suspect any security breaches relating to the Application; and (f) take responsibility for all activities that occur under your account and accept all risks of unauthorized access.

The Application is available to handheld mobile devices running Apple iOS and Android Operating Systems. In order to use the Application, you are required to have a compatible Device and Internet access.

Apple and Google Terms and Conditions; Starbucks Policies

These Terms supplement and incorporate (a) in case the Application is distributed through Apple, Inc.’s ("Apple") system, Apple’s Terms and Conditions (located at www.apple.com/legal/itunes/us/terms.html#service) including, without limitation, the Licensed Application End User License Agreement provided therein ("Apple Terms"); (b) in case the Application is distributed through Google Inc.’s ("Google") system, Google Play Terms of Service (located at https://play.google.com/about/play-terms.html) ("Google Terms"); and (c) other Starbucks policies ("Starbucks Policies"), including, but not limited to, the terms of use for the Starbucks Website (as defined below), the Starbucks stored value card ("Starbucks Card") and the Starbucks Reward Program, the Starbucks Privacy Policy, and any other policies which Starbucks may issue from time to time, posted at www.starbucks.com.hk ("Starbucks Website"). If any of the provisions of the Apple Terms, Google Terms or any applicable Starbucks Policies conflict with these Terms, these Terms will control, solely to the extent such provisions apply to the Application.

User License

Subject to these Terms, Starbucks grants the User a personal, non-exclusive, non-transferable, limited and revocable license to use the Application for personal and/or non-commercial use only on an Apple iPhone, iPad or iPod Touch or an Android device (each a "Device") owned or controlled by the User as permitted by the Apple Terms or the Google Terms and in accordance with these Terms ("User License"). Any use of the Application in any other manner, including, without limitation, resale, transfer, modification or distribution of the Application or text, pictures, music, barcodes, video, data, hyperlinks, displays and other content associated with the Application ("Content") including these Terms is prohibited. These Terms and User License also governs any updates to, or supplements or replacements for, this Application unless separate terms accompany such updates, supplements or replacements, in which case the separate terms will apply.

Any and all rights in the Application are and shall remain the exclusive property of Starbucks. Nothing in these Terms intends to transfer any such rights to, or to vest any such rights in, the User. Users are only entitled to the limited use of the Application granted to Users under these Terms. Starbucks reserves all rights not expressly granted under these Terms.

The User is responsible for any costs associated with downloading, installing, accessing and/or using the Application which may depend and vary on the terms and conditions of the User’s own mobile device service provider.

Starbucks may, at any time and without giving notice to you, make changes, corrections and/or improvements to the Application, stop providing the Application or features of the Application to you or to Users generally, or create usage limits for the Application.

These Terms are effective until terminated. You may terminate these Terms at any time by uninstalling the Application and destroying all copies of the Application in your possession.

We may suspend or terminate these Terms at any time by giving you reasonable prior notice. We need not, however, give you notice where we have serious grounds for considering that immediate termination is required (e.g. if we reasonably suspect fraudulent or unauthorized use of the Application). In the event that these Terms are terminated, the provisions of these Terms shall continue to apply as between us in respect of anything either of us did whilst these Terms were in force.

Upon any termination, you agree to uninstall the Application immediately and destroy all copies of the Application, any accompanying documentation, and all other associated materials. Starbucks reserves the right to terminate these Terms at any time if you are in breach of any of the terms of these Terms.

Online Payment

Users who download the Application to a Device may also elect to participate in certain functionality of the Application which will allow the User to use a Device to purchase a virtual Starbucks Card, or load value to or make payment by a Starbucks Card or a virtual Starbucks Card (collectively, “Starbucks Card”) or to transfer any or all of the outstanding balance from one Starbucks Card to another Starbucks Card in accordance with these Terms and the Starbucks Policies including, but not limited to, the Starbucks Card Account Terms of Use and Agreement (located at Starbucks.com.hk/Card) or which will allow the User to use a Device to make payment by credit card in accordance with these Terms and the Starbucks Policies ("Online Payment"). Starbucks reserves the right at any time to discontinue any or all of the functions of Online Payment.

If the User elects to use the Online Payment functionality of the Application, the User may also elect to use the functionality of the Application to allow the User to automatically reload a Starbucks Card that is registered with the User’s Starbucks account by using the Application and/or the User’s Starbucks account online via the Starbucks Website. The User may simply set the reload amount at which the User wants to reload the Starbucks Card each time the Starbucks Card balance is below a certain selected amount and register the auto-reload function with the User’s designated credit card, and such auto-reload amount shall be paid via the registered credit card and loaded onto the Starbucks Card. Each auto-reload transaction will be displayed under the account transaction history in the Application or by logging into the User’s Starbucks account online via the Starbucks Website. Users can change their auto-reload preferences and details (including but not limited to the auto-reload amount, the amount of the balance which triggers an auto-reload and the credit card to be charged for auto-reload), or turn off the auto-reload function, at any time via the Application and/or the User’s Starbucks account online via the Starbucks Website. Changes may require at least 24 hours to take effect. Only one auto-reload transaction can be carried out per day and 12:00 midnight is the cut-off time for each day. Once any dollar value is loaded onto a Starbucks Card, the transaction cannot in any event be cancelled and/or reversed.

Mobile Order and Pay (MO&P) and Mobile Order To Table

Users who download the Application to a Device may also elect to participate in certain functionality of the Application which will allow the User in certain participating Starbucks stores in Hong Kong and Macau to (a) use the Application to order and pay for certain Starbucks products using a Starbucks Card prior to arrival at the store ("MO&P"); (b) use the Application to order, pay for certain Starbucks products; (c) if you make your order with MO&P (“First Order”) and stay in a participating Starbucks store, an alert will be sent through the Application after certain time of the First order on whether a subsequent order for certain Starbucks products is required, which alert you may click for ordering and paying for certain Starbucks products using a Starbucks Card (“Nudge Service”); or (d) use the Application to pay for certain Starbucks products using a Starbucks Card and enjoy delivery of such products to the table in a participating Starbucks store where you locate by scanning the QR code on the table (“Mobile Order To Table”). MO&P, [Nudge Service and Mobile Order To Table] is accepted at all the participating Starbucks stores in Hong Kong and Macau except the stores located at the Hong Kong Baptist University, HKUST, Hong Kong University Student Union, Hong Kong University Library, Eastern Hospital, Pacific Place Level 1, Asia World-Expo, Wynn Macau and Hotel Wynn Palace (Back of House). Starbucks reserves the right at any time to discontinue MO&P, Nudge Service or Mobile Order To Table or change the location of the participating stores accepting MO&P, Nudge Service or Mobile Order To Table.

Email Communications, Text Communications and Push Notifications

If a User signs up for a Starbucks account using the Application, the User will be given the opportunity to opt-in or opt-out to receive promotional email communications from Starbucks ("Email Communications"). Thereafter, the User may opt-in or opt-out of receiving Email Communications at any time by adjusting the User’s profile settings in the User’s Starbucks account via www.starbucks.com.hk.

Similarly, upon download of this Application, the User is, provided the option to opt-in or to opt-out of receiving push notifications from Starbucks on their Device and within the Application. This may include Nudge Service notifications, promotional communications, pick-of-the-week offers, and system messages pushed to the Device or within the Application mailbox ("Push Notifications"). The User may, at any time following download of this Application, opt-in or opt-out of receiving Push Notifications by type by adjusting the "Starbucks Notifications" switch within the Application settings to "off", or within the Device’s settings application under "Notifications" to completely opt out of Push Notifications. Opting out of Push Notifications will not affect User settings with respect to Email Communications.

The sending of Email Communications and Push Notifications is described further in, and will be governed by, the Starbucks Privacy Policy (for details of the Starbucks Privacy Policy, please check the Starbucks website at www.starbucks.com.hk).

User Information

Some functionality of the Application, including Online Payment and MO&P, purchase of virtual Starbucks Card, Nudge Service, Mobile Order To Table, Starbucks eGift and location based services and functionality, may require the transmission of information provided by the User including but not limited to usernames and passwords, addresses, e-mail addresses, financial information (such as credit card numbers), the International Mobile Equipment Identity number accessed in the User’s Device, phone-book information, information related to a Starbucks Card or GPS location ("User Information"). In order to use certain Application functionality, such as and location-based services and technology, the User must either: (a) enable "location services" in the Application; and/or (b) set the permissions in his or her mobile device to allow communication of this information. If the User uses such Application functionality, the User consents to the transmission of User Information to Starbucks, its agents and/or service providers and authorizes Starbucks, its agents and/or service providers to record, process and store such User Information as necessary for the Application functionality, and for purposes described in, and in accordance with, the Starbucks Privacy Policy (for details of the Starbucks Privacy Policy, please check the Starbucks website at www.starbucks.com.hk). Please see the Privacy Policy for more information about how we may use and store such User Information, and how to opt-in and opt-out of sharing User Information, including GPS location.

The User is solely responsible for maintenance of the confidentiality and security of any User Information which the User transmitted from or stored on a Device for purposes of the Application, including Online Payment, MO&P, Nudge Service and Mobile Order To Table, for all transactions and other activities undertaken with any Starbucks Card registered in the User’s name or in relation to purchase of Starbucks eGift, whether authorized or unauthorized. The User agrees to immediately notify Starbucks of any unauthorized transactions associated with the Application including Online Payment, MO&P, Nudge Service and Mobile Order To Table, or any other breach of security. Starbucks shall not be responsible for any losses arising out of the loss or theft of User Information which the User transmitted from or stored on a Device or from unauthorized or fraudulent transactions associated with the Application.

Unacceptable Use

Use by the User of the Application and any Content and User Information transmitted in connection with the Application is limited to the contemplated functionality. The User agrees that his or her use of the Application and any Content must comply with these Terms and the Starbucks Policies. In no event may the Application be used (whether by the User or a third party allowed by the User) in a manner that (a) harasses, abuses, stalks, threatens, defames or otherwise infringes or violates the rights of any other party (including but not limited to rights of publicity or other proprietary rights); (b) is unlawful, fraudulent or deceptive; (c) uses technology or other means to access the Application, Starbucks Website or Content that is not authorized by Starbucks; (d) uses or launches any automated system, including without limitation, "robots," "spiders," or "offline readers," to access the Application, Starbucks Website or Content; (e) attempts to introduce viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (f) attempts to gain unauthorized access to Starbucks computer network or user accounts; (g) encourages conduct that would constitute a criminal offense, or that gives rise to civil liability; (h) violates these Terms; (i) attempts to damage, disable, overburden, or impair Starbucks servers or networks; (j) impersonates any person or entity or otherwise misrepresents your identity or affiliation with another person or entity; (k) fails to comply with applicable third party terms; (l) makes and/or distribute copies of the Application; (m) attempts to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Application; or (n) create derivative works of the Application of any kind whatsoever (collectively "Unacceptable Use"). Starbucks reserves the right, in its sole discretion, to terminate any User License, terminate any User’s participation in Online Payment, MO&P, Nudge Service and/or Mobile Order To Table remove Content or assert legal action with respect to Content or use of the Application, including Online Payment, MO&P, Nudge Service and Mobile Order To Table that Starbucks reasonably believes is or might be in violation of these terms of Unacceptable Use or Starbucks Policies including the Starbucks Card Account Terms of Use and Agreement. Starbucks failure or delay in taking such actions does not constitute a waiver of its rights to enforce these Terms. Users agree not to use the Application including, but not limited to, that they not place orders through MO&P, while driving.

Indemnification

At Starbucks’s request, the User agrees to defend, indemnify, and hold harmless Starbucks, Starbucks Corporation and their affiliated companies, independent contractors, service providers and consultants and their respective employees, contractors, agents, officers, directors, representatives, and/or advisers fully from and against any and all claims, suits, losses, damages, costs, lawsuits, fines, penalties, liabilities, and/or expenses (direct and/or indirect, and including legal fees and expenses on a full indemnity basis) that arise from or relate to the User’s use or misuse of the Application (including Online Payment, MO&P , Nudge Service and Mobile Order To Table), violation of these Terms or violation of any rights of a third party. Starbucks reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the User, in which event the User will cooperate in asserting any available defenses. In the event of any third party claim that the Application or User’s possession and use of the Application infringes that third party’s intellectual property right, Starbucks, Starbucks Corporation and their affiliated companies, and their employees, contractors, agents, officers, directors, representatives, and/or advisers, not Apple or Google, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Warranties; Disclaimers

STARBUCKS IS PROVIDING THE APPLICATION TO THE USER ON AN "AS IS" AND "AS AVAILABLE" BASIS, AND THE USER IS USING THE APPLICATION AT HIS OR HER OWN RISK. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, STARBUCKS DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW, TRADE USAGE, OR OTHERWISE, INCLUDING ANY WARRANTIES THAT THE APPLICATION IS MERCHANTABLE, RELIABLE, AVAILABLE ACCURATE, FIT FOR A PARTICULAR PURPOSE OR NEED OR SATISFACTORY QUALITY, NON-INFRINGING OR FREE OF DEFECTS OR VIRUSES OR ABLE TO OPERATE ON AN UNINTERRUPTED BASIS, OR THAT THE USE OF THE APPLICATION BY THE USER IS IN COMPLIANCE WITH LAWS APPLICABLE TO THE USER THAT USER INFORMATION OR MO&P TRANSMITTED IN CONNECTION WITH THE APPLICATION (INCLUDING AS PART OF ONLINE PAYMENT, MO&P, Nudge Service and Mobile Order To Table WILL BE SUCCESSFULLY, ACCURATELY OR SECURELY TRANSMITTED OR RECEIVED, THAT MO&P, Nudge Service and Mobile Order To Table WILL BE AS PLACED OR READY AT THE SUGGESTED TIME,OR THAT ANY PARTICULAR ITEM ORDERED WILL BE AVAILABLE.

Starbucks reserves the right to amend or withdraw the Application, or charge for the Application (but we will give you the opportunity to decide whether or not to continue to use the Application and accept such charge) or service provided to you in accordance with this Agreement, at any time and for any reason.

Starbucks will use reasonable efforts to make the Application available at all times. However you acknowledge that the Application is provided over the Internet and mobile networks and so the quality and availability of the Application may be affected by factors outside Starbucks’ reasonable control. Starbucks does not accept any responsibility whatsoever for unavailability of the Application, or any difficulty or inability to download or access content or any other communication system failure which may result in the Application being unavailable.

No Liability

TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL STARBUCKS, STARBUCKS CORPORATION AND THEIR AFFILIATED COMPANIES (A) BE LIABLE TO THE USER WITH RESPECT TO USE OF THE APPLICATION, INCLUDING WITHOUT LIMITATION PARTICIPATION IN ONLINE PAYMENT, MO&P, Nudge Service and Mobile Order To Table; AND (B) BE LIABLE TO THE USER FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOST PROFITS, LOSS, THEFT OR CORRUPTION OF USER INFORMATION, THE INABILITY TO USE THE APPLICATION OR ANY OF ITS FEATURES OR DEVICE FAILURE OR MALFUNCTION. THE USER’S SOLE REMEDY IS TO CEASE USE OF THE APPLICATION OR TO CEASE PARTICIPATION IN ONLINE PAYMENT, MO&P, Nudge Service and Mobile Order To Table. TO THE FULLEST EXTENT ALLOWABLE UNDER APPLICABLE LAW, IN NO EVENT (BUT SUBJECT TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW) SHALL THE AGGREGATE LIABILITY OF STARBUCKS, STARBUCKS CORPORATION AND THEIR AFFILIATED COMPANIES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE APPLICATION EXCEED ANY COMPENSATION THE USER PAYS, IF ANY, TO STARBUCKS FOR ACCESS TO OR USE OF THE APPLICATION DURING THE SIX MONTHS PERIOD IMMEDIATELY PRIOR TO THE EVENT GIVING RISE TO SUCH LIABILITY. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS, NOTHING IN THESE TERMS SHALL EXCLUDE OR RESTRICT STARBUCKS, STARBUCKS CORPORATION AND THEIR AFFILIATED COMPANIES’ LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM THEIR NEGLIGENCE.

Marks, Application and Content

"Starbucks Coffee Company", "Starbucks", the Starbucks logo, and other Starbucks trademarks, service marks, graphics and logos used in connection with the Application are trademarks or registered trademarks of Starbucks Corporation (collectively "Starbucks Marks"). Other trademarks, service marks, graphics and logos used in connection with the Application are the trademarks of their respective owners (collectively "Third Party Marks"). The Starbucks Marks and Third Party Marks may not be copied, imitated or used, in whole or in part, without the prior written permission of Starbucks or the applicable trademark holder. The Application and the Content are protected by copyright, trademark, patent, trade secret, international treaties, laws and other proprietary and intellectual property rights, and also may have security components that protect digital information only as authorized by Starbucks or the owner of the Content.

Third Party Content, Applications, Products and Services (including Advertising and Promotions)

Starbucks may provide third party content in the Application (including embedded content) or links to third party content, applications, products and services, including advertisements and promotions (collectively, "Third Party Content") as a service to those interested in this information. We do not control, endorse or adopt any Third Party Content, including that the inclusion of any link does not imply affiliation, endorsement or adoption by Starbucks of any application or any information contained therein, and can make no guarantee as to its accuracy or completeness. You acknowledge and agree that Starbucks is not responsible or liable in any manner for any Third Party Content and undertakes no responsibility to update or review such Third Party Content. You agree to use such Third Party Content contained therein at your own risk. When you use other applications via Third Party Content, or participate in promotions or business dealings with third parties, you should understand that our terms and policies no longer govern, and that the terms and policies of those third party applications will now apply. You should review the applicable terms and policies, including privacy and data gathering practices, of any application to which you navigate from our Application.

Governing Law and Jurisdiction

These Terms and use of the Application are governed by the laws of Hong Kong, without regard to conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods shall have no applicability. The User irrevocably consents to the non-exclusive jurisdiction of the courts of Hong Kong for purposes of any legal action arising out of or related to the use of the Application or these Terms.

Changes

Starbucks reserves the right to change or modify these Terms or any other Starbucks Policies related to use of the Application at any time and at its sole discretion, changing these Terms within the Application or by posting revisions on the Starbucks Website. Subject to the remainder of this clause, any change, addition or deletion will become effective at the time we post the revised Agreement to our web site, on the Application, in our stores, or as otherwise stated in our notice to you. We will use our reasonable endeavours to notify you of such changes (including, but not limited to, by email at the email address you provided to us when you registered your account). The amended Terms will apply to you if (1) you do not notify us in writing to the contrary within twenty (20) days of the date of our notice (or such other reasonable period of time as specified in our notice to you), or (2) you continued to use the Application following the posting and/or notification to you of these changes or modifications. If you do not accept the changes, you will not be able to use the Application.

Assignment

We may transfer all or part of these Terms without such transfer being considered a change to these Terms, by giving notice to you. The company or other entity to whom we transfer these Terms will have the same rights and obligations as we did before the transfer and we will ensure that it agrees in writing to be bound by the terms and conditions of these Terms so that your rights under these Terms are not detrimentally affected and we will then be released from all liability.

Entire Agreement; Construction

These Terms will be in the English language and the Chinese language. In the event of any inconsistency between the English version and the Chinese version, the English version shall prevail. These Terms are the complete and exclusive statement of agreement between you and Starbucks, an authorized licensee of Starbucks Corporation in Hong Kong, and supersedes all prior proposals and all other agreements in respect of the subject matter of this Agreement. If any provision of these Terms is illegal or unenforceable, that provision will be deleted from these Terms, and the remaining terms will not be affected. Headings are for convenience of reference only and will in no way affect interpretation of these Terms. Our failure to exercise or to enforce any right or provision of these Terms will not constitute a waiver of such right or provision, and any waiver of any provision of these Terms will be effective only if in writing and signed by us.

Third Party Rights

These Terms do not create any right enforceable by any person who is not a party to this Agreement under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) (the "Ordinance"), but this provision does not affect a right or remedy of a third party that exists or is available apart from this Ordinance.

Starbucks Card Account Terms of Use and Agreement

IMPORTANT -- PLEASE READ: The following Starbucks Card Agreement (this "Agreement", these "Terms") describes the terms and conditions that apply to the stored value account of your Starbucks Card. This Agreement should be read together with the Starbucks Privacy Policy, the Starbucks Hong Kong Mobile Application Terms of Use, the Starbucks Reward Program Terms of Use, and any other policies which the Starbucks Corporation and/or Coffee Concepts (Hong Kong) Limited, an authorized licensee of Starbucks Corporation in Hong Kong ("Starbucks" or "we" or "us" or "our") may issue from time to time (together, "Starbucks Policies"), provided that if any of the provisions of any applicable Starbucks Policies conflict with these Terms, these Terms will control, solely to the extent such provisions apply to the Starbucks Card.

PART ONE: STARBUCKS CARD GENERAL TERMS

About Your Account; Starbucks Purchases Only

The Starbucks Card is issued to you by Starbucks Corporation (“Starbucks” or “we” or “us”). It allows you to load a monetary value on to your Starbucks Card for purchases at participating Starbucks stores. The Starbucks Card is to be treated like cash. It cannot be replaced if lost, stolen or destroyed unless you have registered it and reported the loss as described below. The monetary value that you, as a Starbucks customer, load onto your Starbucks Card is a pre-payment for the goods and services of participating Starbucks stores only. No credit card, credit line, overdraft protection or deposit account is associated with a Starbucks Card. No interest, dividends or any other earnings on funds loaded on to a Starbucks Card will accrue or be paid or credited to you by Starbucks. The value associated with the Starbucks Card is not insured or guaranteed by any person or entity.

Your Starbucks Card is valid for use only at participating Starbucks® stores in Hong Kong and Macau. We reserve the right not to accept any Starbucks Card or otherwise limit use of a Starbucks Card if we reasonably believe that the use is unauthorised, fraudulent or otherwise unlawful.

You may purchase a Starbucks Card by using a credit card or cash by visiting any participating Starbucks store. You may also purchase a virtual Starbucks Card by using a credit card [(VISA or MasterCard)] online at our mobile application, or by other means as we may designate from time to time.

Loading Value on Your Card

In Hong Kong, you can load value onto a Starbucks Card by using a credit card (VISA or MasterCard) or cash by visiting any participating store. You may also top up an existing Starbucks Card by using a credit card (VISA or MasterCard) online at our web site at www.starbucks.com.hk or at our mobile application, or by other means as we may designate from time to time. If you choose to top up your Starbucks Card online or at our mobile application, any personal data which you provide to us in order to do so will be held pursuant to the Starbucks Privacy Policy (for details of the Starbucks Privacy Policy, please check the Starbucks website at www.starbucks.com.hk) and by proceeding with the topping up and/or auto-reload facility, you will be agreeing to this arrangement.

The value of your Starbucks Card is subject to the following load limits: a maximum value of HK$4,000 may be stored on any Starbucks Card at any given time, and if you top up your Starbucks Card online or at our mobile application, the minimum amount that can be loaded is HK$100; if you top up your Starbucks Card at any participating store, the minimum amount that can be loaded is HK$50 and increasing in denominations of HK$50. Starbucks may change these maximum and minimum amounts at any time by notifying you at the point of sale or on the Starbucks web site or on our mobile applications, or through other means from time to time (including, but not limited to, by email), and such change shall not constitute and will not require an amendment to this Agreement.

Amounts loaded, and subsequently topped up, onto a Starbucks Card are held and denominated in the currency of the market in which it was initially issued regardless of the currency used to load the Card. When adding value to your Starbucks Card or using it to make a purchase outside of the market in which it was issued or purchased, foreign currency conversion calculations are based on exchange rates published daily by Bloomberg. No fees or other charges are assessed to your Starbucks Card for the conversion. When using your Starbucks Card outside of the market in which it was issued or purchased, the balance shown on your receipt at the point of sale will be in the domestic currency of the store location you are visiting.

Starbucks Card eGifts

The Starbucks Card eGift program allows you to purchase and send a virtual Starbucks Card via email. You may choose the design and any dollar value between HK$50 and HK$1,000 (increasing in denominations of HK$50) and complete your purchase using a credit card online at our web site at www.starbucks.com.hk or at our mobile application. You will need the email address for the recipient of your eGift.

The recipient of your eGift will receive an email notifying them that they have received an eGift from you. He or she will have the option of printing out the eGift and bringing it into a participating Starbucks store to make a purchase or applying it to an existing Starbucks Card registered in the recipient’s Starbucks Card account. The recipient will also have the option to register the eGift for use with our mobile application. You will receive an email confirming the recipient’s receipt of your eGift when the eGift is opened.

A Starbucks Card eGift is exactly like any other Starbucks Card and should be treated like cash by the recipient. Each eGift has a unique Starbucks Card number and only one card associated with it no matter how many times the email is printed out. eGift printouts should be kept in safe place against unauthorized use. If an eGift is registered with us, the eGift may be entitled to the balance protection following the requirements set out in the Section "Optional Registration; Liability for Unauthorized Transactions".

Fees and Expiry Date

Starbucks does not charge any fees for the issuance, activation, use or reloading of your Starbucks Card unless otherwise stated.

Your Starbucks Card balance will expire three years after the date of the last transaction. Any remaining balances on Starbucks Cards that have not been used for any transactions within a three-year time period will be forfeited immediately and without further notice. For the avoidance of doubt, notwithstanding anything to the contrary in this agreement, any such remaining balance shall be non-refundable.

Receipts and Statements

Starbucks Card holders are not sent statements of itemised transactions from a Starbucks Card account. You can check the balance of your Starbucks Card or review the last ten recent transactions on your Starbucks Card on our web site at www.starbucks.com.hk, or on our mobile application or by calling (852) 2101-1399. When you use your Starbucks Card at a participating Starbucks store, you will receive a receipt if you request one but will not be asked to sign the receipt. The receipt will indicate that the purchase was made using a Starbucks Card and will provide the remaining balance of your Starbucks Card. You should keep your receipts and check your online statement to ensure that your account balance is correct.

Redemption

All reward benefits are valid only within their stipulated periods.

No Refund

In general, there will be no refund of the balance value on your Starbucks Card but you can use such value for purchases at the participating Starbucks stores.

Complaint Handling

We reserve the right to correct the balance of your Starbucks Card account if we believe that a clerical, billing or accounting error has occurred. If you have questions regarding your transaction history or any correction, or if you dispute any transaction or correction that has been assessed against your Starbucks Card, please contact our Customer Care Team by phone on (852) 2101-1399 and we will conduct an investigation and communicate the results and correct any error that we verify as soon as we finish the investigation. If no error was found, we will communicate an explanation. We will have no liability for any billing error unless you provide us notice within sixty (60) days of the date of the transaction in question. You should monitor your transactions and account balances closely.

Optional Registration; Liability for Unauthorised Transactions

To register your Starbucks Card, please visit our web site at www.starbucks.com.hk. You may also register your Starbucks Card through our mobile application. Please notify us immediately if you change any of your registration information. Personal Information which you provide to us for purposes of registering your Starbucks Card will be held pursuant to the Starbucks Privacy Policy (for details of the Starbucks Privacy Policy, please check www.starbucks.com.hk).

If your registered Starbucks Card is lost, stolen, damaged, or destroyed, you should contact us immediately at (852) 2101-1399. Your Starbucks Card balance is only protected from the point in time that you notify us that the Card is lost, stolen, damaged, or destroyed. We will freeze the remaining balance on your Starbucks Card at the time you notify us and will load that remaining balance on your replacement Starbucks Card.

Because your Starbucks Card stores value for purchases from Starbucks, you are responsible for all transactions associated with your Starbucks Card, including unauthorized transactions. However, if your Starbucks Card is lost, stolen, damaged, or destroyed, the card can be replaced with the balance remaining on it at the time you notify us of the same, but only if you have registered the Starbucks Card with us.

If you decide to register your Starbucks Card, you shall follow the guidance provided by us from time to time (including, but not limited to, through the Starbucks website and/or our mobile application) in designating a password (the "Password") when registering your Starbucks Card. You may change the Password at any time, but any change shall be effective only if accepted by us. You shall act in good faith, exercise reasonable care and diligence in keeping the Password. At no time and under no circumstances shall you disclose the Password to any other person. You shall be fully responsible for any accidental or unauthorized disclosure of the Password to any other person, and shall bear the risks of the Password being used by unauthorized persons or for unauthorized purposes. Upon notice or suspicion of the Password being disclosed to any unauthorized person or any unauthorized use of your account or your Starbucks Card being made, you shall notify us immediately and, until our actual receipt of such notification, you shall remain responsible for any and all use of your account and/or your Starbucks Card by unauthorized persons or for unauthorized purposes.

PART TWO: IMPORTANT LEGAL TERMS

Your obligations

You shall:

  • use the Starbucks Card for the purpose of purchasing goods and services of participating Starbucks stores only;
  • take reasonable care to avoid losing, damaging, or destroying your Starbucks Card;
  • indemnify, defend, and hold harmless Starbucks, Starbucks Corporation and their affiliated companies, independent contractors, service providers and consultants and their respective employees, contractors, agents, officers, directors, representatives, and/or advisers, fully from and against any and all claims, suits, losses, damages, costs, lawsuits, fines, penalties, liabilities, and/or expenses (direct and/or indirect, and including legal fees and expenses on a full indemnity basis) arising from or relate to your misuse of the Starbucks Card, violation of these Terms or violation of any rights of a third party. Starbucks reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defenses. In the event of any third party claim relating to infringements of a third party’s intellectual property right, Starbucks, Starbucks Corporation and their affiliated companies, and their employees, contractors, officers, and directors, not Apple or Google, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Changes to This Agreement

We may amend the terms of this Agreement at any time for security, legal, regulatory or valid business reasons. We will post the amendments to the terms of this Agreement on our web site at www.starbucks.com.hk and on our mobile application, and otherwise use our reasonable endeavours to notify you of such changes (including, but not limited to, by email if you have registered your Starbucks Card). Subject to the remainder of this clause, any change, addition or deletion will become effective at the time we post the revised Agreement to our web site, on our mobile application, in our stores, or as otherwise stated in our notice to you. Unless we state otherwise, the change, addition or deletion will apply to your future and existing Starbucks Cards. The amended terms will apply to you if (1) you do not notify us in writing to the contrary within twenty (20) days of the date of our notice (or such other reasonable period of time as specified in our notice to you), or (2) you use your Starbucks Card at any time on or after such change, addition or deletion are posted and/or notified to you as described above. If you do not accept the changes, additions or deletions, your Starbucks Card will be cancelled and any amounts remaining on your Starbucks Card will be refunded to you.

Cancellation of This Agreement

We may suspend or terminate this Agreement at any time by giving you reasonable prior notice. We need not, however, give you notice where we have serious grounds for considering that immediate termination is required (e.g. if we reasonably suspect fraudulent or unauthorized use of the Starbucks Card). If we terminate this Agreement in circumstances where it is determined you are not in breach of this Agreement, we will refund or issue stored credits equal to the balance held in your Starbucks Card account less any amounts that you owe us. In the event that this Agreement is terminated, this Part Two shall continue to apply as between us in respect of anything either of us did whilst this Agreement was in force.

Legal Age

If you are under 18 or considered as underage by law or do not have the ability to make a contract or are unable to bear any legal responsibility, and/or if registering or using your Starbucks Card would give rise to legal obligation or responsibilities, you must seek the approval of your parent or guardian regarding the legal implications of these Terms and the consequences that entail. Starbucks assumes that you are of legal age or have obtained the approval of your parent or guardian.

Governing Law

This Agreement is governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, and the parties hereto irrevocably submit to the non-exclusive jurisdiction of the Hong Kong courts.

Disclaimers and Limits of Liability

SAVE AS EXPRESSLY PROVIDED IN THIS AGREEMENT, ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW, TRADE USAGE, OR OTHERWISE, INCLUDING WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE OR SATISFACTORY QUALITY OR NON-INFRINGEMENT, AND ANY AND ALL LOSSES, DAMAGES (INCLUDING DIRECT, INDIRECT, CONSEQUENTIAL OR EXEMPLARY, LOSS OF PROFITS OR INCOME), COMPENSATION OR INDEMNIFICATION ARE, INSOFAR AS PERMITTED BY THE APPLICABLE LAW, HEREBY EXPRESSLY EXCLUDED BY STARBUCKS.

In particular, but without limitation, Starbucks does not represent or warrant that:

  • your Starbucks Card will always be accessible or accepted at participating Starbucks stores;
  • the Starbucks Card and related services will always be available, timely, secure, error-free, or uninterrupted, and you understand and agree that we may suspend or withdraw or restrict the availability of all or any part of the Starbucks Card and related services for reasonable business and/or operational reasons.

In the event that Starbucks is held liable to you under this Agreement, you will be entitled to recover from us your actual damages, up to the last balance held on your Starbucks Card in question. To the maximum extent permitted by applicable law, Starbucks will not be liable to you for:

  • any loss of income, business, goodwill or profits arising out of this Agreement;
  • any unauthorized access to or alteration, theft, damage, or destruction of your Starbucks Card;
  • the consequences of any delay or mistake relating to the use of your Starbucks Card caused by any circumstances beyond our control;
  • any loss or damage which was not caused by our breach of this Agreement or breach of our legal duty of care;
  • any loss or damage which was not a reasonably foreseeable result of either our breach of this Agreement or breach of our legal duty of care. Loss or damage is "reasonably foreseeable" if, at the time we entered into this Agreement, such loss was contemplated by you and by us;
  • any indirect, consequential, special, punitive, or exemplary losses or damages; or
  • any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage.

Notwithstanding anything to the contrary in this Agreement, nothing in this Agreement shall exclude or restrict our liability for death or personal injury resulting from our negligence. This Agreement does not affect your statutory rights and must be read subject to those rights. If you require more information on your statutory rights you should contact a lawyer.

Assignment

We may transfer all or part of this Agreement without such transfer being considered a change to the Agreement, by giving notice to you. The company or other entity to whom we transfer this Agreement will have the same rights and obligations as we did before the transfer and we will ensure that it agrees in writing to be bound by the terms and conditions of this Agreement so that your rights under this Agreement are not detrimentally affected and we will then be released from all liability.

Entire Agreement; Construction

This Agreement will be in the English language and the Chinese language. In the event of any inconsistency between the English version and the Chinese version, the English version shall prevail. This Agreement is the complete and exclusive statement of agreement between you and Starbucks, an authorized licensee of Starbucks Corporation in Hong Kong, and supersedes all prior proposals and all other agreements in respect of the subject matter of this Agreement. If any provision of this Agreement is illegal or unenforceable, that provision will be deleted from this Agreement, and the remaining terms will not be affected. Headings are for convenience of reference only and will in no way affect interpretation of this Agreement. Our failure to exercise or to enforce any right or provision of this Agreement will not constitute a waiver of such right or provision, and any waiver of any provision of this Agreement will be effective only if in writing and signed by us.

Third Party Rights

This Agreement does not create any right enforceable by any person who is not a party to this Agreement under the Contracts (Rights of Third Parties) Ordinance (Chapter 623 of the Laws of Hong Kong) (the "Ordinance"), but this provision does not affect a right or remedy of a third party that exists or is available apart from this Ordinance.

Personal Information which you provide to us for purposes of registering your Starbucks Card will be held pursuant to Starbucks Privacy Policy (For details of Starbucks Privacy Policy, please check www.starbucks.com.hk). If your registered Starbucks Card is lost, stolen or damaged, you should contact us immediately at 0800933. Your Starbucks Card balance is only protected from the point in time that you notify us that the Card is lost, stolen or damaged. We will freeze the remaining balance on your Starbucks Card at the time you notify us and will load that remaining balance on your replacement Starbucks Card.

PART TWO: IMPORTANT LEGAL TERMS

Changes to This Agreement

We may amend the terms of this Agreement at any time for security, legal, regulatory or valid business reasons. We will post the amendments to the terms of this Agreement on our web site at www.starbucks.com.hk and notify you of such changes. Subject to the remainder of this clause, any change, addition or deletion will become effective at the time we post the revised Agreement to our web site or in our stores or as otherwise stated in our notice to you. Unless we state otherwise, the change, addition or deletion will apply to your future and existing Starbucks Cards. The amended terms will apply to you if (1) you do not notify us in writing to the contrary within twenty (20) days of the date of our notice (or such other reasonable period of time as specified in our notice to you), or (2) you use your Starbucks Card after such twenty (20) day notice period. If you do not accept the changes, additions or deletions, your Starbucks Card will be cancelled and any amounts remaining on your Starbucks Card will be refunded.

Cancellation of This Agreement

We may suspend or terminate this Agreement at any time by giving you reasonable prior notice. We need not, however, give you notice where we have serious grounds for considering that immediate termination is required (e.g. if we reasonably suspect fraudulent or unauthorized use of the Starbucks Card). If we terminate this Agreement in circumstances where it is determined you are not in breach of this Agreement, we will refund or issue stored credits equal to the balance held in your Starbucks Card account less any amounts that you owe us. In the event that this Agreement is terminated, this Part Two shall continue to apply as between us in respect of anything either of us did whilst this Agreement was in force.

Legal Age

If you are under 18 or considered as underage by law or do not have the ability to make a contract or are unable to bear any legal responsibility, and when registering or using your Starbucks Card would give rise to legal obligation or responsibilities, you must seek the approval of your parent or guardian regarding the legal implications of these Terms of Use and the consequences that entail. Starbucks assumes that you are of legal age or have obtained the approval of your parent or guardian.

Governing Law

This Agreement is governed by the laws of the Macau Special Administrative Region of the People’s Republic of China.

Disclaimers and Limits of Liability

Starbucks does not represent or warrant that your Starbucks Card will always be accessible or accepted at participating Starbucks stores.

In the event that Starbucks is held liable to you under this Agreement, you will be entitled to recover from us your actual damages, up to the last balance held on your Starbucks Card in question. Starbucks will not be liable to you for:

  • any loss of income, business, goodwill or profits arising out of this Agreement;
  • any unauthorized access to or alteration, theft or destruction of your Starbucks Card;
  • the consequences of any delay or mistake relating to the use of your Starbucks Card caused by any circumstances beyond our control;
  • any loss or damage which was not caused by our breach of this Agreement or breach of our legal duty of care;
  • any loss or damage which was not a reasonably foreseeable result of either our breach of this Agreement or breach of our legal duty of care. Loss or damage is "reasonably foreseeable" if, at the time we entered into this Agreement, such loss was contemplated by you and by us; or
  • any loss or damage suffered by you as a result of you failing to take reasonable precautions against such loss or damage.

This Agreement does not affect your statutory rights and must be read subject to those rights. If you require more information on your statutory rights you should contact a lawyer.

Assignment

We may transfer all or part of this Agreement without such transfer being considered a change to the Agreement, by giving notice to you. The company or other entity to whom we transfer this Agreement will have the same rights and obligations as we did before the transfer and we will ensure that it agrees in writing to be bound by the terms and conditions of this Agreement so that your rights under this Agreement are not detrimentally affected and we will then be released from all liability.

Entire Agreement; Construction

All correspondence entered into under this Agreement will be in the English language. This Agreement is the complete and exclusive statement of agreement between you and Coffee Concepts (Macau) Limited, an authorized licensee of Starbucks in Macau, and supersedes all prior proposals and all other agreements in respect of the subject matter of this Agreement. If any provision of this Agreement is illegal or unenforceable, that provision will be deleted from this Agreement, and the remaining terms will not be affected. Headings are for convenience of reference only and will in no way affect interpretation of this Agreement.

These Terms of Use apply to your access to, and participation in, the Starbucks Rewards™ program ("Starbucks Rewards™") which is operated by Coffee Concepts (Hong Kong) Ltd. and Coffee Concepts (Macau) Ltd. (collectively, "Starbucks"), the licensees of Starbucks Corporation in Hong Kong and Macau. These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with Starbucks for products, services or otherwise. Starbucks reserves the right to change, modify and/or terminate the Starbucks Rewards™ and/or these Terms of Use or any policy, FAQ, or guideline pertaining to Starbucks Rewards™ at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to www.starbucks.com.hk, and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in the Starbucks Rewards™ confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies from time to time to understand the terms and conditions that apply to Starbucks Rewards™. Starbucks Rewards™ is not targeted towards, nor intended for use by, anyone under the age of 18. If you are between the ages of 13 and 18, you may only use Starbucks Rewards™ under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.

Starbucks Rewards™ Program

Program Overview

Starbucks Rewards™ is one way in which Starbucks endeavors to reward and thank loyal customers for patronizing at Starbucks Coffee stores. To enroll in Starbucks Rewards™ and receive program benefits, you will first need to create a "Starbucks Card" account at Starbucks.com.hk/Card or with the Starbucks Hong Kong mobile application distributed by Starbucks in Hong Kong and Macau ("Starbucks Hong Kong mobile app") and then activate and register at least one (1) Hong Kong or Macau activated Starbucks Card to your account. "Starbucks Card" activated in Hong Kong or Macau may include physical Starbucks branded plastic cards that are available and activated in participating Starbucks stores in Hong Kong or Macau and digital forms of the physical cards through Starbucks Hong Kong mobile app. "Activation" means that you have loaded a minimum of HKD50 / MOP50 onto your Starbucks Card for the first time. You can register any Starbucks Card activated in either Hong Kong or Macau to your account at Starbucks.com.hk/Card or through the Starbucks Hong Kong mobile app.

The registration process may require that you provide the following information using the online registration form: username, password, email address (required in order to receive all eligible Rewards), Starbucks Card number, and card security code (CSC), birthday month, name, physical address, and mobile number. All of your Starbucks Cards activated in Hong Kong or Macau can be registered for use in Starbucks Rewards™ under these Terms of Use. For ease of reference, in these Terms of Use, the term "Starbucks Card" refers to a Starbucks Card that may be activated in Hong Kong or Macau only, and the term "activated, registered Starbucks Card" refers to a Starbucks Card that has been activated in Hong Kong or Macau and registered to your Starbucks Card account at Starbucks.com.hk/Card or through the Starbucks Hong Kong mobile app.

Starbucks Rewards™ benefits are determined based on the amount of "spending" you made and the number of "Stars" that you earned through your spending with your activated, registered Starbucks Card(s). A "Star" for purposes of Starbucks Rewards™ means each time you use your activated, registered Starbucks Card to pay for a transaction at a participating Starbucks store in Hong Kong/Macau only. No "Star" will be rewarded for purchases with an activated, registered Starbucks Card in any Starbucks store outside Hong Kong or Macau or for purchases of Starbucks eGift. For each qualified purchase, you will receive one (1) "Star" for each HKD20 spent in Hong Kong or each MOP20 spent in Macau, except during limited time promotions when Starbucks may offer "Bonus Stars" on featured products and/or services. Stars are for promotional purposes only and have no cash value. You can use any activated, registered Starbucks Card to earn Stars for your spending. Please note that spending will only be calculated and Stars accumulated after the activated Starbucks Card is registered at Starbucks.com.hk/Card or through the Starbucks Hong Kong mobile app.

Currently, there are three (3) levels of benefits in Starbucks Rewards™ which are determined by the number of Stars that you accumulate in your account. By opening an account, and activating and registering a Starbucks Card, you will be automatically enrolled in Starbucks Rewards™ at the Welcome Level. Earn at least twenty- five (25) Stars within the twelve (12) months’ period following your enrollment date and you will proceed to the Green Level. If you earn at least one hundred (100) Stars within the 12 months’ period following your enrollment date, you will qualify for the Gold Level.

Once you reached a specific Level within Starbucks Rewards™, you will receive the benefits that are applicable to that Level only. However, you must continue to accumulate Stars in order to maintain your benefit level:

  • To maintain the Welcome Level, you only need to register your activated Starbucks Card at Starbucks.com.hk/Card or through the Starbucks Hong Kong’s mobile app.
  • To maintain the Green Level, you must earn at least twenty- five (25) new Stars during each consecutive 12 months’ period following the date you reached the Green Level. If you do not obtain 25 Stars in 12 months, you will be placed at the Welcome Level of Starbucks Rewards™ and your Star balance will revert to zero.
  • To maintain the Gold Level, you must earn at least one hundred (100) new Stars during each consecutive 12 months’ eriod following the date you reached the Gold Level. If you do not obtain 100 Stars in 12 months, you will be placed at the Green Level of Starbucks Rewards™ and your Star balance will revert to zero.

Please note that "Stars" accumulated for each level will only be valid for twelve (12) months from the date when you reached the particular level. For example: You activate your Starbucks Card at a participating Starbucks store on May 2, 2015 by loading HKD100 MOP100 onto the Starbucks Card. You register that Starbucks Card on June 1, 2015. Your spending will only be considered as qualified purchase from June 1, 2015 when you can start earning Stars. If you earn 25 Stars on June 15, 2015, you will be placed on Green Level and entitled to Green Level benefits and your entitlement to Green Level benefits will expire on June 14, 2016. On June 15, 2016, your Stars balance will revert to 0. However, if you have accumulated 50 Stars between June 15, 2015 to June 14, 2016 earning the required number of Stars to maintain your Green Level, you will automatically be placed at Green Level and entitled to the various Green Level benefits for the 12 months’ period between June 15, 2016 and June 14, 2017 but your Stars balance will be zero.

Welcome Level

By opening an account, activating and registering your Starbucks Card, you will automatically enter into the "Welcome Level" of Starbucks Rewards™. Benefits may include:

  • One (1) Buy-One-Get-One on tall or above-sized handcrafted beverage upon registration.

Your Buy-One-Get-One reward will be automatically loaded onto your account upon registration of the first Starbucks Card under your account, and will be available to you for three (3) months. The offer for the Buy-One-Get-One reward expires after three (3) months. You must present your first registered Starbucks Card to the barista at a participating Hong Kong / Macau Starbucks store in order to receive your reward. You can view and track your available Rewards on Starbuck.com.hk/Card or using the Starbucks Hong Kong mobile app. You will receive only one Welcome reward throughout the entire period of your participation in Starbucks Reward™ regardless of the number of Starbucks Cards that you have registered to your account. You will no longer receive the Welcome Level benefits after you advance to the Green Level or Gold Level and are placed at the Welcome Level again for any reason.

The Buy-One-Get-One reward may be redeemed at participating Hong Kong / Macau Starbucks stores only, and the Buy-One-Get-One reward is not available to ready-to-drink bottled beverages.

  • One (1) free upgrade on one promotional beverage:

This benefit is only available when Starbucks launches a promotional beverage. You may use any of your registered Starbucks Cards to purchase a tall or above-sized promotional beverage to enjoy free upgrade (to the next larger size) during the first week of its launch. You must present your registered Starbucks Card to the barista at a participating Hong Kong/Macau Starbucks store in order to redeem your free upgrade on promotional beverage. You can view and track your available Rewards on Starbucks.com.hk/Card or using the Starbucks Hong Kong mobile app. The free upgrade on promotional beverage may be redeemed at participating Hong Kong / Macau Starbucks stores only.

Green Level

After having accumulated twenty- five (25) Stars in a 12 months’ period, you advance from the Welcome Level to the "Green Level" of Starbucks Rewards™. During each 12 months’ period when you reached and/or maintained the Green Level, the benefits for Green Level may include:

  • Welcome Level benefits if you have not redeemed such benefits before you advance to Green Level, provided that you must redeem such benefits within three (3) months from the date you registered your Starbucks Card. Welcome Level benefits is only available once in the entire period of your participation in Starbucks Reward™.
  • One (1) free tall size drink once you reached Green Level:

Your choice of one (1) complimentary tall size drink once you reached Green Level. Your complimentary tall size drink reward will be automatically loaded onto your account when you reached Green Level and will be available to you for three (3) months. The offer for the free beverage expires after three (3) months. You must present any of your registered Starbucks Cards to the barista at a participating Hong Kong / Macau Starbucks store in order to redeem your complimentary tall size drink. You must present any of your registered Starbucks Cards to the barista at a participating Hong Kong / Macau Starbucks store in order to redeem your complimentary birthday item. You can view and track your available Rewards on Starbucks.com.hk/Card or using the Starbucks Hong Kong mobile app. You will receive only one (1) complimentary birthday item regardless of the number of Starbucks Cards that you have registered to your account.

The complimentary birthday item may be redeemed at participating Hong Kong / Macau Starbucks stores only, and ready-to-drink bottled beverages is not available for redemption.

  • One (1) free extra espresso shot on any espresso drink purchase

This benefit is only available when you use any of your registered Starbucks Cards to purchase any espresso drink. You must present your registered Starbucks Card to the barista at a participating Hong Kong / Macau Starbucks store in order to redeem your free extra espresso shot.

Gold Level

After having accumulated one hundred (100) Stars in a 12 months’ period, you achieve the "Gold Level." During each 12 months’ period when you reached and/or maintained the Gold Level, the benefits for Gold Level may include:

  • Welcome Level benefits if you have not redeemed such benefit before you advance to Gold Level, provided that you must redeem such benefit within three (3) months from the date you registered your Starbucks Card. Welcome Level benefits is only available once in the entire period of your participation in Starbucks Reward™.
  • Green Level benefits if you have not redeemed such benefit before you advance to Gold Level, provided that you must redeem such benefit within the required period.
  • One (1) free tall size drink once you reached Gold Level:

Your choice of one (1) complimentary tall size drink once you reached Gold level.

Your complimentary tall size drink reward will be automatically loaded onto your account when you reached Gold level and will be available to you for three (3) months. The offer for the free beverage expires after three (3) months. You must present any of your registered Starbucks Cards to the barista at a participating Hong Kong / Macau Starbucks store in order to redeem your complimentary tall size drink. You can also view and track your available Rewards on Starbucks.com.hk/Card or using the Starbucks Hong Kong mobile app. You will receive only one (1) complimentary tall size drink reward when you reached Gold Level regardless of the number of Starbucks Cards that you have registered to your account.

  • Additional personalized offers: Additional personalized offers may be distributed by email or physical mail, so you must opt-in to receive promotional and marketing email offers from Starbucks and provide a valid email or physical mailing address in order to receive them.
  • One (1) free tall size drink or one (1) selected food item for every 25 Stars earned:

    Once you reached the Gold Level, you will earn one (1) free tall sized beverage item or a selected food item for every 25 Stars earned. You may choose one (1) complimentary handcrafted beverage or one (1) complimentary selected food item. Your complimentary item will be automatically loaded onto your account and will be available to you for three (3) months. This offer for the free beverage or free food item expires after three (3) months. You must present any of your registered Starbucks Cards to the barista at a participating Hong Kong/Macau Starbucks store in order to redeem your complimentary item. You can view and track your available Rewards on Starbucks.com.hk/Card or by using the Starbucks Hong Kong mobile app. You will receive only one (1) free tall size drink or one (1) selected food item for every 25 Stars earned regardless of the number of Starbucks Cards that you have registered to your account.

The complimentary item may be redeemed at participating Hong Kong/Macau Starbucks stores only, and ready-to-drink bottled beverages is not available for redemption.

  • Transfer Rewards to your family, friends or others. As a Gold member, you may transfer any of your outstanding Rewards in your Starbucks Card account as shown in the Rewards section in our Starbucks Hong Kong website at www.starbucks.com.hk/Card or in the Rewards section in our Starbucks Hong Kong mobile apps to one of your family members, friends or others by using the Rewards transfer function on our website or mobile apps. You may transfer a Reward only to a recipient who has already registered as a member under Starbucks RewardsTM on our website or mobile apps. To redeem the transferred Reward, the recipient must present his/her registered Starbucks Card under Starbucks RewardsTM to the barista at a participating Hong Kong/Macau Starbucks store. Each Reward has an expiry date for redemption. If the Reward is not redeemed by the prescribed expiry date, it will expire.

Miscellaneous

There are no membership fees associated with Starbucks Rewards™. Stars accumulated under the program have no cash value.

Starbucks may introduce promotion programmes relating to Starbucks Rewards™ whereby these Terms of Use may be varied as applicable to such programmes.

Your Stars, benefits, registered Starbucks Card(s), and your account under Starbucks Rewards™ are personal to you, and except expressly permitted under these Terms of Use or the rules of a promotional programme, may not be sold, transferred or assigned to, or shared with family, friends or others.

Starbucks reserves the right to terminate your account and/or your participation in Starbucks Rewards™ if Starbucks determines in its sole discretion that you have violated these Terms of Use, or that the use of your account is unauthorized, fraudulent or otherwise unlawful.

Starbucks also reserves the right to "unregister" and make ineligible for Starbucks Rewards™ any Starbucks Card that has been inactive for two (2) consecutive years. Inactive is defined as no purchase activity.

Starbucks reserves the right to terminate, discontinue, modify or cancel Starbucks Rewards™ at any time and in its sole discretion without notice to you.

This Starbucks Privacy Policy ("Policy") describes how Coffee Concepts (Hong Kong) Limited and Coffee Concepts (Macau) Limited, authorized licensees of Starbucks Corporation in Hong Kong and Macau respectively, (referred to as "Starbucks" below) use and disclose personal information of customers collected through our websites and online services, including Starbucks.com.hk, Starbucks Hong Kong Mobile Application, and other Starbucks owned or operated websites and online services that link to this policy (collectively, the "Sites"), through our programs and in our physical Starbucks stores ("Services"). This Policy does not apply to websites and services that display or link to different privacy statements. Websites and services co-branded with other partners may display or link to a joint privacy statement or separate privacy statements of our partners in addition to our Policy. By accessing the Sites or utilising the Services, you hereby consent to the use of your information, including your personal information, any information of others provided by you, in the manner described in this Policy. Without limiting the generality of the foregoing, you authorise Starbucks to transmit your information outside Hong Kong and/or Macau in the manner and for the purposes described in this Policy.

What Type of Information Does Starbucks Collect?

Personal Information that may be collected by Starbucks may include:

  • Name, postal address, phone number, and e-mail address.
  • Financial account information, such as credit card number and other payment information.

We may also collect information about you or others as you provided such as:

  • If you create an account - your username, password, your birthday, gender and mobile phone number.
  • If you buy goods at our stores or through our programs or otherwise - what you buy, where you buy, how frequently you buy, rewards you earn, and rewards you redeem.
  • If you buy and send any Starbucks eGift – name and e-mail address of the recipient you selected from your phonebook; and you accept all liabilities in relation to the provision of such information to us for forwarding the eGift in accordance with your instruction.
  • If you register any Starbucks Card – the card number, card transactions, including activating the Starbucks Card, loading value to the Starbucks Card, redeeming any value, balance transfer, balance enquiries.
  • If you use our mobile applications - information such as your device ID, your location and stores near you and visited by you may be collected.
  • If you take a survey or interact with us in various other ways - demographics information, your comments, feedback, questions or suggestions, and information about subjects that may interest you.

Does Starbucks Share Personal Information or Information of Others that you provided with Third Parties?

Starbucks shares your personal information or information of others that you provided in limited ways.

  • We may share personal information about you with others with your consent.
  • We may share information with Starbucks Corporation and its subsidiaries and licensees and our parent and other affiliated companies.
  • We may also share information with companies that provide support services to us (such as credit card processors or other payment services providers, mailing houses or website hosts) and that help us market our products and services (such as email vendors). These companies may use information about you to perform their functions on our behalf.
  • We may disclose specific information (i) upon lawful request, in response to legal process, and when required to comply with laws, (ii) to enforce our agreements with you, our corporate policies and terms of use relating to your use of Starbucks products and services through the Sites or the Services, or (iii) to protect the rights, property or safety of Starbucks and affiliates, Starbucks Corporation and its subsidiaries and licensees, our employees, agents, customers, and others but only when it is reasonable to do so.
